These Terms and Conditions ("Terms", "Terms of Service") govern your use of our mobile applications (the "Apps") and any of our related services operated by NextLeap Apps.
By accessing and using our Apps and Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in full. You may not use our Apps if you do not accept all of the terms and conditions of this Agreement.
This Agreement is legally binding between you ("User", "you" or "your") and NextLeap Apps ("Products", "we", "us" or "our"). You can download or install our apps from the Google Play Store and Apple App Store. By agreeing to these Terms and Conditions, you agree and acknowledge that you are solely responsible for your state of health and well-being when using any health or fitness-related features within our Apps. You must always consult with a qualified healthcare professional before beginning any exercise regimen or making any health-related decisions.
By accessing and/or using our Apps, you agree to accept these terms and conditions. If you do not agree with the terms of this Agreement, you must not accept this Agreement and may not access and use the Apps and Services. NextLeap Apps reserves the right to modify this Agreement or its terms relating to the Apps and Services at any time, in our sole discretion without notice, and are effective immediately upon posting such changes within the Apps or on our website. An updated version of this Agreement will be available on our official website.
Unless otherwise indicated, the Apps or Service is our proprietary property and all source code, texts, videos, logos, images, clips, graphics, icons, data compilations, and information (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us and are protected by copyright and trademark laws.
By using our Apps or Service, you represent and warrant that:
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the applications and services (or any portion thereof).
Our Apps may offer in-app purchases or subscriptions to unlock additional features, content, or services (e.g., personalized plans, advanced workouts, premium content). Payment for these purchases will be processed through the respective app store (Google Play Store or Apple App Store) and is subject to their terms and conditions. Subscriptions will automatically renew unless canceled at least 24 hours before the end of the current period. You can manage your subscriptions and auto-renewal settings through your device's app store account settings.
These services are provided by NextLeap Apps on an "as is" and "as available" basis. NextLeap Apps makes no representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content, or materials included therein. You expressly agree that your use of these services, their content, and any services or items obtained from us is at your sole risk.
NextLeap Apps shall not be liable for any loss or damages, any direct, indirect, punitive, special, incidental, or consequential damage, however it arises, whether in an action of contract, negligence, or other tortious action, or arising out of or in connection with this agreement, including without limitation any claim for personal injury or property damage, arising from this agreement and any violation by you of any federal, state, or local laws, statutes, rules, or regulations, even if the company has been previously advised of the possibility of such damage. Except as prohibited by law, if there is liability found on the part of the company, it will be limited to the amount paid for the products and/or services, and under no circumstances will there be consequential or punitive damages. Some jurisdictions do not allow the exclusion or limitation of punitive, incidental, or consequential damages, so the prior limitation or exclusion may not apply to you.
